CLE: Royal Commission into Misconduct in Banking, Superannuation and Financial Services by James Daniel

James Daniel will be presenting a CLE on the interim report from the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry; dissecting key findings relating to agribusiness and regional lending practices in addition to discussing possible litigation funded claims against banks like Nab, CBA and Suncorp to recover losses suffered by customers affected by banking misconduct.


James is a Partner in the Thomson Geer Brisbane Insolvency and Restructuring Dispute Resolution Team. He has experience in legal practice for the better part of three continuous decades acting in complex and other insolvency and recovery, corporate restructuring and turnarounds, litigation and investigations.


During that time, he has worked on a number of corporate restructuring and turnarounds. For example:


  • Octaviar – currently acting for the Liquidator concerning a claim in the NSW Supreme Court for $100M against turnaround advisors.
  • ENERGEX – Advising the Board during the State directed restructure and sale of ENERGEX’s retail asset for $1.8bn.
  • Norco Co-operative Limited – Advised the Board and Senior Management, together with Ernst & Young and Bentleys, in relation to insolvent trading risk, negotiating a standstill agreement with ANZ, the refinancing of the ANZ facilities through GE Capital on better terms, the divestment of non-core assets and the closure of non performing business units and later acting for the Board in relation to 6 contested company and supplier group meetings including several Board spill meetings over an 18 month period.

This event kicks off at 5:30pm on Melbourne Cup day, so it’s likely that you’ll already be in your spring racewear.  If not, we encourage you to dress up because there will be prizes for best dressed male, best dressed female, and best fascinator!
